Why you need an advance health care directive

An advance health care directive, also known as a living will, is a legal document that outlines your wishes for medical treatment if you become unable to make decisions for yourself due to an illness, injury, or incapacity. The Health and Disability Commissioner (Code of Health and Disability Services Consumers' Rights) Regulations 1996 enable you (if you are legally competent) the right to make an advance directive setting out the treatment wanted or not wanted in the event of you being unable to decide or communicate your preferences in future.

It gives you control over your own medical treatment and helps ensure that your wishes are respected if you become unable to make decisions for yourself. Without an advance health care directive, your family or medical providers may have to make difficult decisions about your medical treatment without knowing your preferences.

Our advance health care directives enable you to record your doctors’ details, your wishes as to treatment if you are on a life-support system, your wishes as to palliative care, the use of your body for medical research, and organ donations. In this way your welfare attorneys loved ones, and doctors can be made aware of your directives on these important matters.

In New Zealand wishes as to assisted dying are invalid if they are included in advance health care directives. You also need to appoint a person to be your enduring power of attorney in relation to your personal care and welfare, through the Protection of Personal Property Rights Act 1988. They then have the power to make decisions about your personal care and welfare, and your advance health care directive details your wishes for their benefit.

Having an advance health care directive also helps reduce stress and confusion for your loved ones during a difficult time, as it clearly states your wishes and provides guidance for medical providers.

Overall, an advance health care directive is an important tool for protecting your autonomy and ensuring that your medical care aligns with your values and beliefs.
